HANSON CONSERVATION COMMISSION
MINUTES OF THE PUBLIC MEETING OF MARCH 25, 2008
TOWN HALL, 542 LIBERTY STREET, HANSON, MA

Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Philip R. Lindquist, Chairman, in Meeting Room A at the Town Hall.

Enforcement

·       62/51 Ocean Avenue
Mr. Vacca reported that Mr. Anderson remains in violation for not installing the silt fence as required and as per inspection of 3/24/08, more junk has been brought onto the site.  Fines are accumulating at $300 per day and another notice has been prepared to send out tomorrow.  Mr. Anderson has accrued over $12,000 in fines.  It is not known whether he has appealed them.
·       270 Main Street
Mr. Vacca reported that as of yesterday, there had been no response to the Enforcement Order requiring that the owner clean up the dumpster area.  Fines shall be issued at $300 per day if the violation persists.

Discussions

·       Water level at Maquan Pond and siltation of outlet stream
Mr. Vacca reported that after having done some additional research on the ownership of the water rights, he discovered that they belonged to Edgewood Bogs.  However, there is still a question of responsibility of the siltation of the outlet pipe and he should have a definitive answer between now and the next meeting.  The office had received three more letters from residents of Maquan Pond concerning the rising water level.  Mr. Lindquist asked what the appropriate level should be.  Mr. Schellenger commented that because it is a naturally existing pond, it would be under the jurisdiction of the Army Corps of Engineers and they should be consulted as to the suitable level of the pond.


·       Request for “Minor Correction” to Order of Conditions at Lot 11A Deer Hill Road Extension (DEP #SE175-0529)
The current owner, Mr. Wayne Turner, presented a revised plan demonstrating a different foundation layout plan.  The house is larger and 5-feet from the limit of work.  The proposed house is to be cantilevered out 2 feet.  The septic design is unchanged.  Originally, an in-ground pool, pavers and a shed had been proposed.  They had been replaced by an above-ground pool, and the removal of the pavers and shed.  Mr. Turner explained that the driveway is relatively the same but the barrier retaining wall was removed to create a natural slope.  Mr. Turner requested that he be allowed to substitute cedar conservation posts with granite posts as an option.

·       Massachusetts Conservation Mapping Assistance Partnership Program (MACMAPP)
Mr. Vacca reported that this Mass GIS grant is still available for ArcView software.  The initial cost is $425 for a $3,000 software package with accompanying back-up information.  In return, Conservation must commit to mapping all of the Open Space in town and make it available to the State GIS mapping program.  Also, Mr. Lindquist, Frank Schellenger, Rich Vacca and Cindy Long, Town Assessor met with Jason Fererico of Polaris to discuss software applications.  His recommendation was to use ArcView so that the Commission can produce maps that can be integrated with the Town’s GIS.

·       NPDES (National Pollution Elimination Discharge System)
Mr. Lindquist reminded the Commission that a stormwater permit agreement exists between the Town of Hanson and the Highway Department.  The permit can be found online at the EPA website.  

·       Vernal Pools
There was also a brief conversation about certification of vernal pools in Hanson.  Mr. Harris will contact the science teacher at the High School to see if she is still interested in certifying the pools with her students.

·       Information Sharing
As various members of the Commission have been attending meetings and/or workshops at different times, it was agreed that they would share the information that they have acuired.  Ms. Nehiley will make copies.







Public Hearings

7:45 PM  Continued Notice of Intent for a proposal to repair an existing septic system which is partially located with the 100’ buffer zone and 200’ outer riparian zone to the Shumatuscacant River at 903 West Washington Street, Map 67, Lot 9A for Daniel and Tammy Maurano represented by Outback Engineering, Inc., 165 E. Grove Street, Middleboro, MA  02346 (DEP #SE175-0542).

·       Order of Conditions to gain access to a site to perform observation holes and perc tests at 0 Independence Avenue, Map 74, Lot 12A for Roland Desrochers, Monson Savings Bank  (DEP #SE175-0543) – signed


Certificate of Compliance

Request for Certificate of Compliance for 712 Monponsett St., Map 88, Lot 1640 for Guy Thompson  (DEP #SE175-541) -Mr. Vacca recommended denial because the soils were still exposed and the site was not stabilized.
